Circular for PIOs/APIOs regarding 2nd appeal under RTI Act

CIRCULAR

          It has come to the notice of undersigned that Public Information Officer/Assistant Public Information Officer does not appear personally in their respective case/s of RTI fixed for hearing of Second Appeal before the Hon’ble Central Information Commission, New Delhi.

          Moreover, in the recent cases in file Nos. CIC/CUOPJ/A/2018/112961 & CIC/CUOPJ/A/2018/112963, the Hon’ble Central Information Commission, New Delhi has held that:

“The concerned CPIO has deputed his representative to appear on his behalf before the Commission. However, no cogent reason has been given by his representative for such deputation. The CPIO should note that in such an event, prior permission of the commission is to be taken and there should be a valid justification for not being able to present himself before the Commission. On account of any such failure, the Commission may take appropriate action against the concerned CPIO”.

           In the light of above the Public Information Officers/Assistant Public Information Officer are advised to appear personally in their respective case(s) which is/are fixed for hearing before the Hon’ble Central Information Commission, New Delhi, in future, in the interest of the University.
